1. Agreement to Terms

By accessing or using our services at invictusdriver.com and its subdomains (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not access or use our Service.

2. SMS Messaging and Program Disclosures

Invictus Driver (Invictus Systems Group LLC) provides account notifications, booking alerts, status updates, and support messages via SMS (Short Message Service).

• Consent and Opt-In: By subscribing to our notification services or completing any form that requests your mobile phone number, you consent to receive automated and manual text messages (SMS) from us. SMS consent is completely optional and is not a condition of purchasing any goods or services.
• Opt-Out / Stopping Messages: You can cancel the SMS service at any time. Simply text STOP to our dedicated phone number or reply STOPto any message we send. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.
• Help and Support: If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly by contacting us at support@invictusdriver.com.
• Message Frequency: Message frequency varies based on your booking activity and account configuration.
• Carriers and Fees: Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

3. Acceptable Use

You agree not to use the Service to upload, transmit, or distribute any content that is unlawful, defamatory, abusive, offensive, or violates third-party rights. You may not attempt to gain unauthorized access to our systems or disrupt the integrity of the Service.

4. Direct Payments and Stripe Connect

All payment transactions are processed directly via Stripe Connect. Invictus Driver acts only as a technology provider. You agree to comply with Stripe's terms and conditions. We take a small platform commission per transaction as agreed upon when setting up your account.

5. Limitation of Liability

Invictus Driver (Invictus Systems Group LLC) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Service.

6. Governing Law

These Terms of Service and any action related thereto will be governed by the laws of the United States of America, without regard to or application of its conflict of law provisions.
